In a Private School and the Public School's responsibility to evaluate for IEP The Question Asked:
"My 12 year old 6th grade boy is ADHD and ODD. Diagnosed via outside psychologist psychiatrist a couple years ago and on adderall XR. He has a 504 but we are in a private school setting which is following the one set it place by his previous private school (before moving), although they really aren’t doing the accommodations set forth in it. I called an IEP request meeting for all suspected areas of disability with the public school we now reside in, and had a meeting with both public and private school in mid October. The public school of course refused to acknowledge they should test him and the fact that his MAP scores are high and he isn’t failing are the reasons they wrote in his PWN for test denial and that they want to wait how the next 6 weeks go. In this timeframe he has more late and missing homeworks and his grades have lowered in almost all subjects and he’s now failing in 2 subjects. We work with him on incentives and check in with him about what’s due and how things are going. His output no where near matches his abilities and desires. The public school special ed person is now saying that they won’t be at the next 6 week meeting they set up because they don’t do 504s for private school students. How do I explain in writing to the public school that they set up this 6 week check up period and in my opinion we are still working towards an IEP not a 504 situation? What do I do to convince them they need to test him in all areas of suspected disability?"
