From the Video: A lot of times, people are injured on the job and will have a third party claim as well as the workers' compensation claim. If you are injured in the course and scope of your employment, and a third party is actually liable for your damages as well, you can bring both a workers' compensation claim and a civil claim. You do however, have to do the workers' compensation claim first, and once that is completed or settled, you can move on to the third party civil claim.
However, you cannot do the civil claim first and then the workers' compensation claim because you will, in fact, lose the right to bring both claims.
